Rahat Fateh Ali Khan gets big relief in inheritance property case

Renowned singer Rahat Fateh Ali Khan has got a major relief from the Lahore High Court in the inheritance property dispute case.

The Lahore High Court has quashed the trial court’s decision dismissing Rahat Fateh Ali Khan’s appeal for non-payment of court fees. Justice Muhammad Sajid Mahmood Sethi, issuing an 8-page detailed judgment, restored Rahat Fateh Ali Khan’s appeal and directed him to deposit a fine of Rs 100,000.

Rahat Fateh Ali Khan had filed a case in the civil court to confirm the possession of a one-kanal, nine-marla double-story house in Faisalabad, on which the civil court had issued a degree against him on May 14, 2019.

He had filed an appeal in the trial court against this decision, but the trial court dismissed the appeal on technical grounds for non-payment of court fees of Rs 15,000.

The Lahore High Court wrote in its judgment that dismissing the appeal on a mere technical flaw like non-payment of court fees is against the requirements of justice. The court said that the right to appeal is a valuable legal right and cannot be taken away on technical grounds alone. The trial court had given Rahat Fateh Ali Khan only four days’ time, which was insufficient.

The court ordered all the parties to appear before the relevant court on June 2 and directed the trial court to decide the appeal on its merits within two months.
